By downloading, installing, or using EchoPulse, you agree to these terms. Please read them carefully.
By downloading, installing, or using the EchoPulse mobile application ("the App," "EchoPulse," "we," "us," or "our"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the App.
These Terms apply to all users of the App, including those who create accounts, browse content, post content, or use any features or services offered through EchoPulse.
You must be at least 13 years of age to create an account and use EchoPulse. If you are between 13 and 18 years of age, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
By using EchoPulse, you represent and warrant that you meet the eligibility requirements described above and that the information you provide during registration is accurate, current, and complete.
To use most features of EchoPulse, you must create an account by providing a valid email address and password or by authenticating through Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information when creating your account. You must keep this information up to date. You may not impersonate another person, entity, or brand.
You are responsible for safeguarding your account credentials. You must notify us immediately if you become aware of any unauthorized access. EchoPulse is not liable for any loss or damage arising from your failure to maintain account security.
Each individual may maintain only one EchoPulse account. Creating multiple accounts to circumvent bans, restrictions, or these Terms is prohibited.
EchoPulse allows you to create, upload, share, and interact with various types of content, including:
You retain ownership of the User Content you create and share on EchoPulse. We do not claim ownership of your content.
By posting User Content on EchoPulse, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, display, distribute, and make available your User Content in connection with operating, providing, promoting, and improving the App. This license exists only for the purpose of running and improving EchoPulse and does not limit your rights to your own content.
This license continues for as long as your User Content remains on the platform. When you delete content or your account, we will make commercially reasonable efforts to remove your content from our systems, subject to backup and caching timelines.
When you create a post, you may choose its visibility level: Public (visible to all EchoPulse users), Followers (visible only to users who follow you), or Private (visible only to you). You are responsible for selecting the appropriate visibility setting.
EchoPulse uses a Whisper rating system that allows users to express their opinion using one of six labels: Perfect, Loved, Decent, Fell Short, Skip This, or No Opinion. These ratings represent the personal opinion of the user who created the post and do not constitute endorsements or reviews by EchoPulse.
Posts may be tagged with a specific business, establishment, or freelancer/independent service provider. Tagging a business or freelancer does not imply any endorsement by or affiliation with that entity unless the account is a Verified Merchant account (see Section 5).
EchoPulse allows businesses and independent service providers (collectively, "Merchants") to create Merchant accounts. Merchants are distinguished by a visible badge: Verified Business for businesses with a physical location or defined service area, and Verified Freelancer for individual independent service providers. The Verified badge indicates that the Merchant has registered on EchoPulse and agreed to our Terms. Verification does not constitute an endorsement of the quality of the business or services provided.
Merchants who create profiles on EchoPulse agree to provide accurate and truthful information, respond to reviews professionally, not post fake reviews of their own business or competitors, not harass or threaten users who post reviews, and comply with all applicable laws regarding advertising and consumer protection.
Merchants may post a single response to reviews about their business. Merchant responses must comply with all content rules in these Terms. Merchants may not edit, remove, or suppress reviews. Responses are additive only and appear below the original review.
Merchants may promote their business through sponsored posts in the EchoPulse feed. Sponsored posts are clearly labeled and comply with applicable advertising disclosure requirements. EchoPulse reserves the right to accept or reject any sponsored content request at its sole discretion.
The Verified Business or Verified Freelancer badge will be displayed next to the Merchant's name across all parts of the app, including on their profile, on review responses, and on any content they create.
EchoPulse provides a flagging tool that allows users to report content they believe violates these Terms. Users may flag a post for: Fake review, Looks like an advertisement, Spam, or Inappropriate content. Flagging is anonymous — the original poster will not be notified that their post has been flagged.
Posts that receive a threshold number of flags may be automatically hidden from the main feed pending manual review. The exact thresholds are subject to change at our discretion.
We reserve the right, but are not obligated, to review, monitor, or moderate User Content. We may remove any content and suspend or terminate any account that we determine, in good faith and consistent with our community standards, violates these Terms or is harmful to other users or the platform.
If your content is removed or your account is suspended, you may contact us to request a review. We will make reasonable efforts to respond, but our decisions regarding content moderation and account enforcement are final unless required by law.
EchoPulse uses automated systems, including algorithmic ranking and recommendation technology, to determine which content appears in your feed, which businesses and posts are surfaced in search results, and which content is recommended to you based on your activity and location. These systems are designed to show you content that is relevant and useful, but they do not guarantee that any specific content, business, or user will be shown to you or to others. We may update our ranking and recommendation algorithms at any time.
EchoPulse provides direct messaging and group chat functionality. Messages are private between participants and are stored on our servers to enable real-time delivery and message history.
Messages on EchoPulse are not end-to-end encrypted. While we take reasonable measures to protect message data, you should not use EchoPulse messaging to transmit sensitive personal information such as financial details, passwords, or other confidential data.
EchoPulse reserves the right to access, review, and disclose message content as necessary to investigate reported abuse, enforce these Terms, comply with applicable law, respond to legal process, or protect the rights, safety, or property of EchoPulse, our users, or the public. By using the messaging features, you acknowledge and consent to this limited right of access.
Messages you have sent in conversations will remain visible to the other participant(s) even after you delete your account, as they are part of shared conversation records. If you wish to remove your messages, you must do so before deleting your account.
EchoPulse offers a Nearby feature that uses your device's GPS location to show posts and businesses near your current position. This feature requires your explicit permission to access device location services. You may grant or revoke location permissions at any time through your device settings. The Nearby feature will not function without location access, but all other App features will continue to work normally.
EchoPulse may now or in the future offer monetization features including sponsored posts and promoted business listings, affiliate links, creator monetization programs, and brand sponsorships. Where sponsored or promoted content appears in the App, it will be clearly labeled as such. EchoPulse complies with applicable advertising disclosure requirements, including FTC guidelines.
EchoPulse respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). We will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable intellectual property laws.
If you believe that content on EchoPulse infringes your copyright, you may submit a takedown notice to: legal@echopulse.app
If you believe content was removed in error, you may submit a counter-notification to our DMCA agent with the information required under 17 U.S.C. Section 512(g)(3). Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the content after the required waiting period.
EchoPulse has a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of intellectual property rights.
EchoPulse includes dedicated categories for content relevant to families and children at various life stages. Users who post in these categories are expected to maintain the highest standards of accuracy, care, and community responsibility. Content in these categories that is misleading, harmful, or inappropriate for the intended audience will be treated as a priority moderation matter.
The App, including its design, code, branding, logos, graphics, user interface, features, and underlying technology, is the property of EchoPulse and is protected by copyright, trademark, and other intellectual property laws. "EchoPulse," the EchoPulse logo, and related branding are trademarks of EchoPulse. You may not use these marks without our prior written consent.
EchoPulse uses the following third-party services to operate: Cloudinary (media storage and processing), Firebase by Google (user authentication and database), Expo (push notification delivery), and Google OAuth (optional sign-in method). External links and content shared by users are the responsibility of those users.
Your use of EchoPulse is also governed by our Privacy Policy, which describes how we collect, use, store, and share your information. By using the App, you consent to the data practices described in our Privacy Policy.
You may delete your EchoPulse account at any time through the Settings screen. Account deletion is permanent and irreversible. Upon deletion, we will make commercially reasonable efforts to remove your profile, posts, comments, and media from our systems. Some information may persist in backups for a limited period. Messages you have sent will remain visible to other conversation participants after your account is deleted.
EchoPulse is not directed to children under the age of 13 and does not knowingly collect personal information from children under 13. If we discover that an account belongs to a child under 13, we will immediately delete that account and all associated data without notice. If you are a parent or guardian and believe your child under 13 has created an account, please contact us immediately at privacy@echopulse.app.
EchoPulse is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We do not endorse, verify, or guarantee the accuracy, completeness, or reliability of any User Content, including reviews, ratings, or business recommendations. Content shared on EchoPulse is not professional advice. Always consult qualified professionals before making decisions based on information found in the App.
To the maximum extent permitted by applicable law, EchoPulse, its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total aggregate liability shall not exceed the greater of the amount you paid to EchoPulse in the twelve months preceding the claim or one hundred U.S. dollars ($100).
You agree to indemnify, defend, and hold harmless EchoPulse, its owners, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or related to your use of the App, your User Content, or your violation of these Terms.
Before filing any formal legal claim, you agree to first contact us and attempt to resolve the dispute informally within thirty (30) days.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and that you will not bring or participate in any class action or representative proceeding against EchoPulse.
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this document. If we make material changes, we will provide notice through the App. Your continued use of EchoPulse after changes take effect constitutes your acceptance of the revised Terms.
